This Privacy Policy explains how Matheu Industries LLC, a Nevada limited liability company doing business as MAD Lion Digital (“MAD Lion Digital,” “we,” “us” or “our”), collects, uses, shares and protects information about you when you visit madliondigital.com and our related websites (the “Site”), contact us, request a free diagnosis, receive our emails or text messages, or otherwise interact with us. It also explains the choices and rights you have.
By using the Site you acknowledge this Policy. If you do not agree with it, please do not use the Site. Your use of the Site is also governed by our User Agreement.
1. Who we are and what this Policy covers
MAD Lion Digital is a marketing agency based in Las Vegas, Nevada, with operations in Guatemala. We provide digital and medical marketing, email marketing, websites, branding, reputation management, strategy and related services to businesses.
This Policy covers information we collect for our own purposes as the business responsible for it, for example through the Site, our forms, our own marketing and our business relationships. When we handle information on behalf of a client (for example, a client’s customer or patient email list), we act as that client’s service provider or processor, and the client’s own privacy policy governs that information. See Section 7.
2. Information we collect
Information you give us
- Free diagnosis and contact forms: your name, email address, phone number, business name, type of business, website, approximate marketing budget, the services you are interested in, expected email volume and anything you write in the message field.
- Social Health Check: the brand or profile names and the public social media figures you enter for your own brand and for competitors (followers, posts and interactions). These calculations run in your browser; we only receive them if you request the PDF report, together with your name, email address and business name.
- Consent records: whether you agreed to our User Agreement and this Policy and, if you choose to, whether you agreed to receive text messages, together with the date, time, IP address and browser information at the moment you gave consent, so we can prove and honor your choices.
- Communications: the content of emails, messages, calls and meetings with us.
- Client and business information: if you become a client, vendor or partner, the business contact, billing and project information needed to work together. Payment card details are handled by our payment processors and are not stored on our servers.
Information collected automatically
- Device and usage data: IP address, browser type and version, operating system, referring page, pages viewed, date and time of visits and similar technical information recorded in server logs and by our hosting, content delivery and security providers.
- Cookies and similar technologies: described in Section 5.
- Email engagement: if you receive our emails, we may record whether a message was delivered, opened or clicked, using standard tracking pixels and links.
Information from other sources
- Publicly available business information, such as your company website, business listings and public social media profiles, which we may review when preparing a diagnosis or proposal.
- Information from service providers and platforms you choose to connect with us, such as advertising, analytics or social media accounts, when you give us access as a client.
We do not ask for, and you should not send us through the Site, Social Security numbers, financial account numbers, medical records or other sensitive information.
3. How we use information
- To respond to your requests, prepare your free diagnosis or Social Health Check report, send proposals and provide our services.
- To communicate with you by email, phone and, only if you consented, text message.
- To send you marketing about our services, which you can opt out of at any time.
- To operate, secure, maintain and improve the Site, including preventing spam, fraud and abuse.
- To keep business, billing and consent records and to comply with legal, tax and regulatory obligations.
- To enforce our agreements and protect the rights, property and safety of MAD Lion Digital, our clients and others.
- For any other purpose we describe when we collect the information, or with your consent.
We may create aggregated or de-identified information that does not identify you and use it for any lawful purpose. We will not attempt to re-identify de-identified information.
4. How we share information
We do not sell your personal information, and we do not share it for cross-context behavioral advertising. We do not sell or share text-messaging opt-in data or phone numbers with third parties for their marketing purposes.
We share information only as follows:
- Service providers who help us run our business under contracts that limit their use of the information, including website hosting and content delivery, email hosting and delivery, cloud infrastructure, form and email processing, customer relationship and productivity software, payment processing, analytics (if enabled with your consent) and professional advisers such as accountants and lawyers.
- Our team and affiliates, including our staff and contractors in the United States and Guatemala and companies under common ownership with Matheu Industries LLC, who are bound by confidentiality obligations.
- At your direction, for example when you ask us to work with your other vendors or platforms.
- Legal and safety reasons: to comply with law, legal process or government requests; to enforce our agreements; or to protect the rights, property or safety of anyone.
- Business transfers: in connection with a merger, acquisition, financing, reorganization or sale of assets, subject to this Policy.
5. Cookies and similar technologies
Cookies are small files stored by your browser. We use similar technologies such as local storage and pixels. We group them as follows:
- Strictly necessary: required for the Site to work, keep it secure, remember your cookie choice, protect forms from spam and, for our staff, keep administrators signed in. These cannot be switched off through our cookie notice, but you can block them in your browser, which may stop parts of the Site from working.
- Analytics and advertising (optional): used to understand how visitors use the Site and to measure or improve our marketing. We only set optional cookies if you choose “Accept all” in our cookie notice. If you choose “Essential only,” or if your browser sends a Global Privacy Control signal, we will not set them.
The Site loads web fonts from Google Fonts. When your browser requests these fonts, Google receives your IP address and browser information under its own privacy policy. Google Fonts does not set cookies.
You can change your choice at any time using the Cookie settings link at the bottom of every page, and you can delete or block cookies in your browser settings. To learn more about managing cookies, visit aboutcookies.org. Some optional advertising tools also offer their own opt-outs, such as optout.aboutads.info and Google My Ad Center.
Do Not Track and Global Privacy Control: there is no common standard for “Do Not Track” browser signals, so the Site does not respond to them. We do honor the Global Privacy Control (GPC) signal as an opt-out of optional cookies and of any sale or sharing of personal information.
6. Email and text messages
Email. Every marketing email we send includes our physical mailing address and a working unsubscribe link. We process unsubscribe requests promptly, and in any case within 10 business days. We may still send you non-marketing messages about services you requested or an account you hold.
Text messages. We only send text messages to people who gave consent, which is optional and never a condition of buying anything. Message frequency varies. Message and data rates may apply. Reply STOP to stop receiving messages or HELP for help, or tell us in any reasonable way that you want to stop, and we will honor it within 10 business days. Mobile carriers are not liable for delayed or undelivered messages.
7. Information we process for our clients
When clients use our services, they may give us information about their own customers, patients or contacts, such as email lists for campaigns or lists to be verified. For that information:
- We act as a service provider, processor or contractor to our client, who remains the business or controller responsible for it.
- We use it only to provide the services the client requested and as permitted by our agreement and applicable law. We do not sell it, combine it with other clients’ data for our own purposes, or use it to market our own services.
- Clients are responsible for having a lawful basis and any required consent to collect the information and to contact the people on their lists.
- If you are on a list we handle for a client and want to unsubscribe, access or delete your information, please contact that client directly. You can also use the unsubscribe link in any email we send on a client’s behalf, or write to us and we will forward your request.
8. Health information, HIPAA and consumer health data
MAD Lion Digital is not a health care provider, and the Site is not intended to collect health information about you. Please do not include personal health information in our forms.
HIPAA. When we work for health care providers, our policy is to keep protected health information (PHI) out of advertising platforms, analytics tools and marketing systems. We will only receive PHI from a client after we sign a business associate agreement (BAA) with that client, and we then handle that information as the BAA and HIPAA require.
Consumer health data laws. We do not collect, use, share or sell “consumer health data” for our own purposes as defined by Nevada law (NRS Chapter 603A, as amended by Senate Bill 370), Washington’s My Health My Data Act or similar laws. When a client asks us to process such data, we act only on that client’s instructions as its processor. If we ever collect consumer health data for our own purposes, we will first update this Policy with the separate consumer health data notice those laws require and obtain any consent they require.
9. AI-assisted tools
We may use artificial intelligence tools from reputable providers to help draft content, analyze campaign results and improve our work. A member of our team reviews AI-assisted work before it is delivered. We do not enter PHI into AI tools, and we limit the personal information we provide to these tools to what the task requires.
10. How long we keep information
We keep personal information only as long as needed for the purposes described in this Policy. As a general guide:
- Diagnosis and contact requests that do not become a client relationship: up to 24 months after our last contact.
- Client, contract and billing records: for the relationship and up to 7 years afterwards for tax, accounting and legal purposes.
- Consent and opt-out records: for as long as we may need to prove consent or honor an opt-out, generally at least 5 years.
- Server and security logs: generally up to 12 months.
- Client-provided lists: for the duration of the engagement, then deleted or returned as our agreement provides.
11. Security
We use reasonable administrative, technical and physical safeguards designed to protect personal information, including encrypted connections (HTTPS), access controls, limited staff access and reputable hosting providers. No method of transmission or storage is completely secure, and we cannot guarantee absolute security. If a data breach affects your personal information, we will notify you and the appropriate authorities as required by applicable law, including NRS 603A.220.
12. Your choices and rights
- Marketing opt-out: use the unsubscribe link in our emails, reply STOP to our texts, or contact us.
- Cookies: use Cookie settings or your browser settings.
- Access, correction and deletion: wherever you live, you may ask us what personal information we hold about you, and ask us to correct or delete it. We will honor these requests where the law requires it, and as a courtesy where we reasonably can, subject to legal exceptions (for example, records we must keep).
To make a request, email info@madliondigital.com with the subject “Privacy request.” We will verify your identity before acting, which may include confirming information we already hold. You may use an authorized agent where the law allows; we may ask for proof of the agent’s authority. We aim to respond within 45 days, and will tell you if we need more time as the law permits. We will not discriminate against you for exercising your rights. If we deny your request, you may appeal by replying to our decision with the subject “Privacy appeal,” and we will respond as required by the law that applies to you.
13. Notice to Nevada residents
This section, together with the rest of this Policy, is our notice under NRS 603A.340.
- Categories of covered information we collect through the Site: first and last name, email address, telephone number, business name and website, and any other information you choose to enter in our forms, plus technical identifiers such as IP address described in Section 2.
- Categories of third parties with whom we may share it: the service providers, team members, affiliates and others described in Section 4.
- Reviewing and changing your information: you can review and request changes to your covered information by emailing info@madliondigital.com.
- Notice of changes: see Section 18.
- Third-party tracking: if you accept optional cookies, third-party analytics or advertising providers may collect information about your online activities over time and across different websites when you use the Site. They do not do so if you choose “Essential only.”
- Sale opt-out: we do not sell covered information as defined in NRS 603A.333. Nevada residents may still submit a request directing us not to sell their covered information by emailing info@madliondigital.com, and we will honor it.
14. Notice to residents of other U.S. states
Several states, including California, Colorado, Connecticut, Delaware, Indiana, Iowa, Kentucky, Maryland, Minnesota, Montana, Nebraska, New Hampshire, New Jersey, Oregon, Rhode Island, Tennessee, Texas, Utah and Virginia, have consumer privacy laws. Depending on where you live and whether the law applies to us, you may have the right to:
- confirm whether we process your personal information and access it;
- correct inaccuracies;
- delete it;
- obtain a portable copy;
- opt out of the sale of personal information, targeted advertising and certain profiling (we do not sell personal information or use it for targeted advertising without your consent through our cookie notice);
- limit the use of sensitive personal information (we do not collect sensitive personal information through the Site); and
- appeal our decision on your request.
We honor these requests for residents of any state, as described in Section 12. California residents: in the last 12 months we collected the categories of information described in Section 2 (identifiers, commercial information, internet activity, and professional information) from the sources and for the purposes described in this Policy, and disclosed them for business purposes to the categories of recipients in Section 4. We have not sold or shared personal information, and we have no actual knowledge of selling or sharing personal information of anyone under 16.
15. International visitors
We are based in the United States, and we also work with clients and team members in Guatemala and other countries. Information we collect is stored and processed in the United States and in other countries where we or our service providers operate, whose data protection laws may differ from those where you live. Where the law requires it, we use appropriate safeguards for these transfers. If you are in the European Economic Area, the United Kingdom or Switzerland, our legal bases for processing are your consent (for example, optional cookies and marketing texts), the performance of a contract or steps you ask us to take before entering into one, our legitimate interests in operating and promoting our business, and compliance with legal obligations. You may also have the right to object to or restrict processing and to complain to your local data protection authority.
16. Children
The Site and our services are intended for businesses and for adults 18 and older. We do not knowingly collect personal information from children under 13 (or under 16 where stricter rules apply). If you believe a child has given us personal information, contact us and we will delete it.
17. Third-party sites and platforms
The Site may link to, or we may work through, third-party websites and platforms such as Google, Meta (Facebook and Instagram), LinkedIn, Yelp and Healthgrades. Their privacy practices are governed by their own policies, and we are not responsible for them.
18. Changes to this Policy
We may update this Policy from time to time. We will post the updated version on this page and change the “Last updated” date above. If we make material changes, we will also give notice through a prominent notice on the Site and, where we have your email address and the law requires it, by email before the changes take effect. Your continued use of the Site after an update means you acknowledge the updated Policy.
